Legal Seminars for Not-For-Profit Organisations
Modern not-for-profit organisations (NFPs) operate in a complex legal and regulatory environment, but often have limited discretionary resources (non project-based funding) with which to navigate their way through these complexities. To assist, JusticeNet is running a series of 3 low-cost seminars in the latter half of 2010 which will cover key legal issues affecting NFPs. The seminars will be presented by senior members of the Adelaide legal community.

Presenter: Arlene Macdonald, Barrister - Edmund Barton Chambers
This session will serve as an introduction or refresher of the tax benefits and tax rules for charitable institutions (using the traditional legal definition which includes “the relief of poverty or sickness or the needs of the aged, the advancement of education, the advancement of religion, and other purposes beneficial to the community"). It will also consider a range of current issues facing charitable institutions. The lecture will include:
- DGR status (gift deducibility for donors and FBT benefits)
- Income tax exemption
- Qualifying for and keeping the tax benefits
- Challenging ATO decisions
- Effect of commercial and lobbying activities
- Useful ATO resources

About the presenter:
Arlene Macdonald BA, LLB, GDLP, FTIA (Life), TEP is a Barrister at Edmund Barton Chambers whose advisory and litigious practice centres on tax and trusts. This includes all Commonwealth and State taxes with a special emphasis on tax disputes, discretionary trust disputes, succession planning and asset protection (including from ex spouses) and charities tax law. She is an experienced and sought after speaker on tax and trusts and related topics in Australia and overseas.
